Text of will;
This is the last will and testament of me Henry Rands of Wellingborough in the County of Northampton Shoe Manufacturer I appoint my brother George Rands of the Town of Northampton in the said County currier and leather seller and Thomas Lister(?) xxxxx xxxxxx of Wellingborough aforesaid Gentleman Trustees and Executors of of this my will asnd give and devise to my said trustees and their heirs all my messauges lands xxxxxx heriditaments and real estate whatsoever situate at Wellingborough aforesaid or xxxxxxx to hold the said unto and to the xxxxx of them my said trustees their heirs and assigns in trust for my wife Jane Rands and her assigns for and during the term of her natural life or so long as as she shall continue my widow and from and immediately after her decease or marrying again which shall first happen devise and bequest upon trust that they my said trustees or the survivor of them or their heirs do and shall as soon as xxxxxxxxly may be made sale and dispose thereof either by public auction or private xxxxxxxx and either together or in parcels and for such xxxxx or xxxxxx money as they or he shall think fit and upon further trust in case my said wife shall betroth(?) xxxxx to pay apply and dispose of the monies to arise from such sale or sales and the costs(?) and profits of my said real estate to xxxxxxx but in the meantime xxxxxxx xxxx xxxxx of my said wife and with sale or sales in with(?) and the same manner as xxxxx xxxxxxxx xxxx with xxxxx to the residue of my personal estate but in case my said wife shall xxxxx married again xxxxx upon trust to (SECOND PAGE) xxxxx out of interest on real or government securities the monies to arise from such sale or sales as aforesaid and to stand xxxxxxx thereof upon trust to pay the dividends interest and proceeds thereof and also the costs and or profits of my said real estate in the mean time and until such sale or sales unto or for the benefit of my five children Henry William James Joseph(?) and George and the survivors or survivor of them until the youngest of my said sons for the time being shall attain the age of twenty one years and then upon trust to pay and distribute the monies to arise as last aforesaid unto xxxxx and amongst my said sons or such of them as shall be xxxxx xxxxxx and the issue of them as shall be xxxxxx in equal shares and xxxxx xxxx xxxx to take a xxxxx share only and for xxxxxx and xxxxx with sale or sales as aforesaid I declare that the receipt of receipts of my said trusteees or the survivor of them or his heirs for the purchase money of my said real estate or any part thereof shall be good and sufficient xxxxxx and surcharges(?) to the purchase or purchases thereof(?) any part thereof and that such purchasor or purchasors having obtained xxxx such receipt or receipts shall not be obliged to xxxxxx the application of such purchase money or any part thereof or be in anycase(?) accountable or xxxxxxxx for the loss misappropriation or nonapplication thereof I give and bequeath all my household goods and furniture plate linen and china unto my said trustees in trust for the use and benefit of my said wife and children in equal shares and proportions and to assign to each of my said sons his(?) share thereof as they shall respectively(?) attain the age of twenty one years and in case any of my said children respectively(?) shall die under the age of twenty one years without issue then as to the share or shares of their xxxxxx so(?) xxxxx as well as any xxxxx share or shares for trust for the survivors of my(?) said children and to be assigned to them in manner(?) herein xxx mentioned And as to all and singular my stock in trade soft monies and securities xxxx (usually 'real') money and all the residue of my personal estate and effects not xxxxx before otherwise disposed of I give and bequeath the same after payment of my just debts and funeral expenses and the expenses of proving and ratifying(?) into execution this my will unto my said Executors upon the trusts herewithto(?) mentioned that is to say upon trust that they or the survivor of them or the executors or administrators of such survivor do(?) and shall herewith carry on my trade or business of a Shoe Manufacturer in the names of my said wife and my son Henry if they shall both be living and my said wife continue my widow and after the decease of either(?) of them or after my said wife marrying again thou(?) as my said Executors or the survivor of them them his executors or administrators shall think fit until my eldest son for the time being shall attain the age of twenty one years for the benefit of my said wife and children(?) and do and shall pay and apply the profits of the said business and the interest of such part of the xx xx monies arising from my said personal estate as shall not be employed in carrying out the same in maintaining xxxxxing and providing all things necessary for my said wife Jane or continuing my business and for all my said children until the eldest of them my said children for the time being shall attain the age of twenty one years and when and as soon as my eldest son for the time being shall attain the age of twenty one years or sooner if they my said Executors or the survivor of them or the executors or administrators of such survivor shall think it expedient(?) and for the advantage of my said wife and children so to do and upon further trust that they xx xxxxxx and shall sell and dispose of the said business and stock in trade <two words inserted> then my said son Henry or my eldest son for the time being the refusal(?) thereof at a valuation and xxxx out the monies arising therefrom and from that personal estate bequeathed to thou as aforesaid (THIRD PAGE) at equal shares and proportions such issue to take a xxxxx share only and to pay and distribute to each of them this and their shares xxxxxx shares as they shall xxxxxx attain the age of twenty one years and to pay and apply the interest dividends and annual profits of the shares or xxxxxx shares of such of them as shall from time to time be xxxxx ago for and towards this xx xxxx maintenance(?) xxxxxx or he shall xxxxx a valuation to be made of the said business and the stock in trade employed therein xxxx and xxx xxxx as my said sons shall respectively attain the age of twenty one years shall pay and distribute to them proportionally(?) his and their share and xxxxx shares thereof and of the residue of my personal estate as they shall xxxxxxxlly attain that age and do and shall pay and apply the profits of the said business and the interest of the undistributed shares of the said residue of my personal estate in maintaining xxxxx and providing all things xxxxxxx for my said wife xxxx continuing my widow and such of my said children(?) as shall from time to time be under age until the youngest of them for the time being shall attain the age of twenty one years old and I do hereby declare my will to be that the said George Rands and Thomas xxxxx Colos(?) Then Codicil;
Whereas of last xxxxxx my xxxxxxx xxxxxx will xxxxxxxx my Trustees and Executors therein named to xxxxx any sum or sums of money to the purpose of putting any of my children as apprentices or otherwise for their benefit out of the principle of the monies thereby given(?) to my said trustees and executors or intended to be thereby trusted(?) in them upon the trusts in my said will mentioned(?) xxxxx therefore and so thereby(?) xxxxxxx my will(?) to be that if it shall be lawful for my said trustees and executors or the survivor of them or the heirs executors or xxxxxx of such survivor if they or he shall think proper with the consent(?) of my said wife during the widowhood to raise and xxxxxx any sum or sums of money by and out of the monies arising from the residue of my personal estate in and by my said will giveth(?) and bequeath to them upon the trusts therexxx mentioned or the monies arising from the sale of my real estate for the purpose of putting out as apprentices or otherwise for the benefit and advantage of any of my said children that xxxx sum or sums of money shall not xxxxx the presumptive(?) or expectant(?) shares or xxxxxx shares of the child or children for whose benefit the same shall be applied and so that xxxxx sum or sums of money shall be taken into account and xxxxxed as part of the share or shares of the said monies arising as aforesaid to xxx which xxxxx child or children xxxxx be entitled xxxxx or by virtue of my said will I xxxxx this writing(?) to be a codicil to my said will and direct(?) the same to be xxxxxxx xxxxxto and taken as part thereof xx xxxxxx whereof I have xxxxx put my hand and seal the twenty fourth day of November(?) one thousand eight hundred and twenty seven HENRY RANDS signed sealed published and xxxxxx by the said Testator Henry Rands as and for a codicil to this last will and testament in the presence of us who at the request in his presence and in the pressure(?) of oath xxxxx have xxxxxts subscribed(?) our names as witnesses Henry A Hodson(?)
